A couple from Cumberland County, Pennsylvania, sued an upscale resort in Key West, Florida, for premises negligence. They are seeking damages in excess of $500,000.
The wife claimed she sustained permanent, life-changing injuries after a slip-and-fall accident at the resort in 2013. The lawsuit was filed against Casa Marina Resort, Waldorf Astoria and Hilton Worldwide in the U.S. District Court Middle District of Pennsylvania on Sept. 8.
The couple stayed at the Casa Marina Resort in September 2013. According to the lawsuit, the resort was promoted as providing easy access to watersports and other beach-related activities. It featured a swimming pier with entry into the sea.
The lawsuit stated that the husband and wife followed all the rules when proceeding to use the steps of the swimming pier. Despite being careful, the wife slipped and fell and suffered a broken arm. The couple alleged that the resort was negligent in providing safe access leading to the ocean.
They claimed loss of wages, earning capacity and marital consortium, as well as medical expenses. The wife underwent extensive medical treatment including a number of surgeries and physical therapy. However, she will never fully regain the use of her arm, according to the lawsuit.
