In November 2016, attorneys filed three lawsuits against e-cigarette manufacturers and retailers regarding e-cigarette explosions and the injuries suffered by three people in three distinct incidents. The case of William Picket was filed in the Ninth Judicial Circuit Court of Orange County, Florida on November 9. The case of David Studer was filed in the Fourth Judicial Circuit Court of Duval County, Fla., on November 10.
Among the defendants are the manufacturers who made the e-cigarettes and/or their batteries. Several of these companies are based in China. The defendants also include the retailers who sold the e-cigarettes and/or their batteries to the plaintiffs.
One of the defendants in the case of Pickett is Samsung, which manufactured the battery that exploded. The lawsuit alleges that the manufacturers were negligent in their design and manufacture of the e-cigarettes, and in their failure to warn consumers of the risks of using the products. Each case focuses on an e-cigarette, or e-cigarette battery, explosion that caused the plaintiff’s injuries.
In Lauria’s case, it is alleged that he was on a vape break from his position as a concierge. He claims that suddenly, the e-cigarette in his mouth exploded, creating a hole between the roof of his mouth and his naval cavity, and breaking his teeth and hand. He also suffered other injuries.

He was then airlifted to the trauma and burn unit at the University of Alabama at Birmingham (UAB), where he received treatment for his injuries, including fractured C-5 vertebrae, burning of the left side of his face and chest area, and scratching of his left eye from debris in the explosion.
Picket’s complaint alleges that while he was driving to work, an e-cigarette exploded in his pocket, causing his leg to be in flames. He suffered second and third degree burns. The third plaintiff, Studer alleges that he suffered second and third degree burns on his thigh when an e-cigarette battery exploded in his shorts’ pocket.
The plaintiffs are seeking damages for pain and suffering, mental anguish, hospital/medical expenses, lost earnings and loss of potential future earnings.
