The Sun-Sentinel reports on a Broward County prosecutor arrested for DUI and hit-and-run. Last Tuesday, a Broward County prosecutor was arrested after Florida State Patrol troopers said that he rear-ended one vehicle and side-swiped another on Interstate 95 Tuesday night.
37-year-old Alim Babayev, was found walking northbound on Interstate 95 just south of the Oakland Park Boulevard exit. He had just tried to beg a passing motorist to let him in his vehicle. That driver had already contacted the Florida State Patrol to report a hit-and-run.
Troopers located Babayev’s white Crown Victoria between the Sunrise and Oakland Park Boulevard exits. The damage to the vehicle was consistent with the damage to the other involved vehicles.
Troopers said that Babayev allegedly appeared intoxicated and smelled of alcohol. He did not consent to a blood-alcohol test and would not perform a field sobriety test. He is accused of driving under the influence and leaving the scene of an accident with property damage. Both charges are misdemeanors. No one was hurt in the accident.
Babayev has been with the prosecutor’s office since February 2017. He has been placed on leave without pay pending the investigation.
Even for a first time DUI, the penalties in Florida are harsh. For a blood-alcohol level of 0.08% or higher, a person faces a fine of at least $500 and up to $1000. This can change if the BAC is above 0.15% or there is a minor in the vehicle, raising to between $1000 and $2000. Imprisonment can range from at least 8 hours and go up to 6 months. If the blood-alcohol level was 0.15% or higher, the jail sentence can go up to nine months. In addition, there is mandatory community service, probation for up to one year, impoundment of the vehicle, and loss of license.
