It may seem straightforward who is at fault, and therefore liable, in a pedestrian accident, but it can be much more difficult to prove liability. First, the victim must prove that the person at fault owes the victim a duty of care. Second, the victim must prove that the person at fault failed in that duty of care. Third, the victim must next prove that negligence caused the victim’s injuries. Finally, the victim must also prove that they suffered from actual harm due to their injuries, such as financial losses and medical bills.
News 4 Jax reports that a deadly crash closed part of International Golf Parkway.
The accident occurred early Friday morning between 5:00 a.m. and 5:45 a.m. in the westbound lanes of International Golf Parkway in St. Johns County.
71-year-old Monica Peterie Long was struck and killed by a vehicle near International Golf Parkway and Royal Pines Parkway. Preliminary evidence suggests that Long was walking near the roadway when the collision happened.
Forensic and video evidence led to the identification of the vehicle. Deputies approached the residence of the alleged driver, 32-year-old Daniel Joseph Vickery. After an interview, officers seized the suspect’s vehicle and Vickery was placed under arrest.
Vickery has been charged with leaving the scene of an accident involving death. The accident is still under investigation.
