Toe et al. v. Cooper Tire & Rubber Co. et al.

After a 2007 crash left one dead and other passengers injured, with one passenger rendered a quadriplegic, the survivors and their families sued Cooper Tire & Rubber, alleging that the tire manufacturer’s negligence contributed to the devastating accident. The individuals involved in the lawsuit were traveling in a 1997 Plymouth Grand Voyager van near Des Moines, Iowa, when the left rear tire, made by Cooper, experienced tread separation, causing the single-vehicle rollover accident. Based on the specifics of the case, the jury sided with the plaintiffs, arriving at a $32.8 million verdict, which included actual damages for the passengers and their families, as well as punitive damages against the tire company.

Cruz et al v. Cooper Tire & Rubber Company

A tragic 2007 accident lies at the center of this lawsuit involving Cooper Tire & Rubber. While driving in Mexico in 2007, a single passenger was killed and others were injured after the 1997 Ford Explorer in which they were traveling was involved in a rollover accident. Those hurt in the accident allege that it was caused by tire tread separation on the car’s left rear tire, which was the underlying cause of the devastating crash. The plaintiffs sued Cooper Tire & Rubber in U.S. District Court. However, because the accident occurred south of the United States border, a District Judge instead sent the case to be heard in a Mexican court, removing it from any U.S. jurisdiction.

Other Recalls and Investigations

The two lawsuits mentioned above both involve catastrophic incidents with devastating results. However, they’re by no means the only ones. The New York Times reported in an October 2001 article that Cooper Tire had announced the settlement of a series of class-action lawsuits over steel-belted radial tires that the company produced, settling at a whopping $34 million.
